I've had my turtles for 2 weeks now, but I've seen them at my mothers house a few times.

The 3in RES has never attacked the 2in RES and they've been in small enclosures the entire time, however recently as to bringing them home, i decided to buy them a few fish, to clean and keep the swimming.

They promptly (3in) over 3 days ate all but 2 including 5 shrimps, recently when the smaller one is swimming above and the bigger one is below her, the big one will start to swim upward and bite the or attempt to (has only done it once successfully that I've caught). I think it's a mistake for food, but who knows.

They used to have a much lower volume of water which may have also been the reason the situation never presented itself. They recently were introduced to prey so that too..

I haven't caught her attacking her in the bathing dock they have or while their swimming side to side at all.

Would you say this was a mistake for food and will this improve once I move them to the 40 gallon tank?

At which size can I be certain one is male or female?

You may need to separate them. Sounds like the start of territorial aggression, which is common in turtles.

I'd think about separating as well. If there are no male characteristics when they're at 4", then I would guess female. Don't forget, some females can be aggressive as well.
